-based on two issues. One is the liability, who is at fault and whether or not you have a certain amount of damages in order to make a claim. If we can prove the other side is 51 percent or more at fault then you do have a claim. In addition, in Massachusetts you must have $200,000.00 of medical bills or have a scar, fracture, disfigurement, death, or dismemberment of a bodily part in order to make a claim for pain and suffering. It's important to act very quickly with respect to lost wages because there's only a certain amount of money available under the auto insurance policy and if the medical bills are submitted before your lost wages the medical providers will get paid first and you will not get your lost wages. So it's important that your lawyer act aggressively and quickly in order to achieve your lost wages immediately. If you are unable to perform your simple daily activities such as grocery shopping and taking kids to school there is a policy provision in order to get you compensated for replacement services. Most lawyers don't know about it but you're entitled to it so you should be able to get what you're entitled to.
